Abstract
Javna nabava je skup pravila i propisa koja državi, njenim tijelima i tijelima s javnim ovlastima propisuju postupke prilikom kupnje roba, radova i usluga, s obzirom da takva tijela ne stječu samostalno financijska sredstva. Najčešćekorišteni postupak javne nabave je otvoreni postupak. Predstavlja najprikladniji postupak za sprječavanje korupcije i dogovaranje cijena. Kada naručitelj provodi navedeni postupak, obvezan je javno objaviti poziv na nadmetanje. Svaki zainteresirani gospodarski subjekt ima pravo podnijeti ponudu koja je u skladu s dokumentacijom o nabavi. Naručitelj ne može unaprijed znati tko će podnijeti ponudu te na kraju postupka sklapa ugovor o javnoj nabavi ili okvirni sporazum. Samo u iznimnim slučajevima, propisanim Zakonom o javnoj nabavi, naručitelj može donijeti odluku o poništenju otvorenog postupka javne nabave.
Abstract (english)
Public procurement is a set od rules and regulations which regulates the acts of buying goods, services and works for countries, its bodies and public bodies, seeing that those kinds of bodies do not acquire financial assets on their own. The most common and the most important method of public procurement is the open tendering. It represents the most suitable method for preventing corruption and for the price regulation. When the customer implements the stated method of public procurement, he is obligated to publicly invite bids. Every interested economical subject has the right to make an offer which is in accordance with procurement documentation. The customer cannot know in advance who will submitt the offer and in the end of the procedure, he should enter into agreement on public procurement or a framework agreement. Only in exceptional circumstances, prescribed by the Law of Public Procurement, the customer can make a decision about the repeal of open tendering public procurement.
